Letter to landowner, Mrs. Gibson, June 2008

Dear Mrs. Gibson,

I am writing you as owner of 3417 and 3419 Fulton Ave, both of which are leased to broadcasting companies for the purpose of transmission of FM radio. Because you are an absent landlord, you may not know what is happening on your property.

Ever since the transmitters were activated in 2000, people living in the area around the towers have made many complaints to Industry Canada and your leasees concerning harmful interference. Normal activities such as use of electrical appliances, telephones, and garage door openers, have been prevented or hindered. The interference has continued unabated and without remedy by your leasees.

In addition, over the last 3-4 years, many of your neighbours have begun to experience various health problems consistent with those found in many scientific studies to be attributable to long-term, chronic exposure to electromagnetic radiation. Many researchers report that these exposure-related problems take several years to manifest themselves. As you know, these transmitters were installed 8 years ago.

As a result of this nuisance and harm, residents of Triangle Mountain are becoming quite fearful and angry. According to Canadian Tort Law, people have the right to enjoy and use their land to a reasonable extent. Since 2000 that has been impossible and on-going “private nuisance“, defined as a situation where property is used in a fashion which disturbs neighbours, has been occurring. Some legal action may be taken against the broadcasters if they continue to transmit from these towers.

I thought I should advise you so that, if you wish, you may take some pre-emptive action and terminate your lease with the broadcasters so that you are not considered a participant in the harmful activity. I hope you will consider the information in this letter as it is intended, a piece of neighbourly advice.
